Legal
The terms, in plain words.
The short version. You get a licence to use Pilcrow on your Apple devices. Everything is free for three days from the first time you type with it; after that you unlock it once, or by the year or month, through Apple. We never receive what you type, so most of what a terms page usually says about your content does not apply here. The rest is below, in order.
1. Who this is with
Pilcrow is published by pilcrowtype keyboard, established in the EU. These terms are an agreement between you and us. They are not an agreement with Apple; see section 9.
They cover the Pilcrow app on your home screen, the Pilcrow keyboard extension, the language packs the app downloads, and this website. Our Privacy policy forms part of these terms.
2. Eligibility
You must be old enough to form a binding contract where you live, and old enough to hold an Apple Account. Where you are under the age of digital consent in your country, a parent or guardian should agree to these terms on your behalf. Pilcrow is not directed at children under 13, and it collects nothing from anyone (see the Privacy policy).
You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
3. Licence
We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use Pilcrow on Apple devices that you own or control, for your own personal use, in accordance with Apple’s App Store terms. Pilcrow is licensed, not sold. All rights not expressly granted are reserved.
You may not copy, modify, reverse-engineer, decompile, disassemble, rent, lease, sell or redistribute Pilcrow, its language packs or its models, except to the extent the law permits this regardless of these terms. Pilcrow, its design, its code, its dictionaries and its models are ours or our licensors’, and are protected by intellectual property law. Third-party components and data sources are listed in the app under Licences & data sources and are used under their own licences.
4. The three free days
Every install of Pilcrow is fully functional for 72 hours from the first time you type with the keyboard, not from installation. No payment details are required, nothing is charged at the end, and nothing renews into anything.
When the free days end and no purchase has been made, the keyboard keeps typing: layouts, languages, emoji and haptics continue to work. Corrections, predictions, swipe typing, learning and themes pause until Pilcrow is unlocked. Nothing the keyboard learned during the free days is deleted.
The free period is measured on your device. Reinstalling the app may or may not start a new one; we make no commitment either way, and we do not treat a second free period on the same device as a right.
5. Purchases and plans
Pilcrow can be unlocked in one of three ways:
- A one-time purchase
- Unlocks Pilcrow for as long as it is available on the App Store, and covers every update we release. It does not renew and is not charged again.
- A yearly plan
- An auto-renewing subscription, charged once a year until cancelled.
- A monthly plan
- An auto-renewing subscription, charged once a month until cancelled.
- Prices are shown in the app and in the App Store in your local currency. Local taxes and the exact amount charged are determined by Apple at checkout, based on your region.
- Payment is charged to your Apple Account at confirmation of purchase.
- A plan renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage or cancel it at any time in your Apple Account settings, under Subscriptions. Deleting the app does not cancel a subscription.
- Purchases can be restored on any device signed in with the same Apple Account, and are shared through Family Sharing where Apple supports it.
- Because the keyboard extension has no network access of its own, it reads your purchase status from a record the app writes on your device. Opening the app occasionally keeps that record fresh; the app will tell you when it needs to.
6. Refunds
Refunds for App Store purchases are handled by Apple under the App Store terms, not by us. We cannot issue a refund ourselves, but write to us and we will point you at the right place and, where it helps, support your request. This does not affect any statutory right you have (see section 8).
7. Price changes
We may change prices for future purchases and for future renewal periods. A change never affects a one-time purchase already made, and never affects a plan already running until its next renewal. Where a price rises for an existing subscription, Apple will notify you in advance and, where required by law or by App Store rules, ask for your consent; if you do not accept, you may cancel before the next renewal and the current period continues at the old price.
8. EU, EEA, UK and Swiss consumer rights
Nothing in these terms limits or excludes the mandatory consumer rights you have under the law of your country of residence.
If you live in the European Economic Area (the EU member states plus Iceland, Liechtenstein and Norway), the United Kingdom, or Switzerland, you normally have a 14-day right of withdrawal for digital content and digital services bought online. By unlocking Pilcrow and using the features it unlocks straight away, you expressly request immediate performance and acknowledge that this right is lost once the service has been fully provided, in accordance with applicable consumer law, including Article 16 of Directive 2011/83/EU and the national law implementing it. Where the right still applies, exercise it through Apple, which is the seller of record.
9. Apple
These terms are between you and us, and not with Apple Inc. We alone are responsible for Pilcrow and its content. If you obtained Pilcrow from the Apple App Store, you acknowledge and agree that:
- Apple has no obligation to furnish any maintenance or support services for Pilcrow.
- Apple is not responsible for addressing any claim by you or any third party relating to Pilcrow or your use of it, including product liability claims, any claim that Pilcrow fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
- In the event of a third-party claim that Pilcrow, or your possession and use of it, infringes that third party’s intellectual property rights, Apple is not responsible for the investigation, defence, settlement or discharge of that claim.
- You must comply with applicable third-party terms when using Pilcrow, including your wireless data plan.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, have the right to enforce them against you.
10. Acceptable use
Use Pilcrow lawfully and for what it is: typing. Do not attempt to interfere with the language pack host or the feedback endpoint, to circumvent the free period or the purchase check, to submit automated or abusive volumes of feedback, or to use Pilcrow in a way that breaks Apple’s terms or the law. We may withhold updates from, rate-limit, or refuse service to an install that does.
11. Your text and your dictionary
Everything you type with Pilcrow, and everything the keyboard learns from it, is yours. We do not receive it, store it, or claim any right in it. The keyboard extension contains no networking code and cannot transmit your text. We do not use your text to train anything. How the small amount of data that does move is handled is set out in the Privacy policy.
If you send us feedback from inside the app, you send us the words you chose to write, and you grant us permission to read them, reply to them, and act on them. Do not paste anything confidential into a bug report.
You are responsible for what you write and where you send it, as with any keyboard.
12. Updates, language packs and availability
We may update Pilcrow, its language packs and its models at any time to improve them, and may add languages or, exceptionally, remove one. Language packs are downloaded by the app from our file host over an internet connection you provide; a pack already downloaded keeps working offline. An update to a language can occasionally need a newer version of the app; until you update, the version you already have keeps working, and the app tells you when an update is available.
We aim to keep the host and the feedback endpoint available, but we do not guarantee uninterrupted access to either, and neither is needed for the keyboard to type. We may modify or discontinue parts of the service; where a change materially reduces what an active paid plan provides, you may cancel it and, where the law requires, seek a proportionate refund through Apple.
13. No warranty
Pilcrow is provided “as is” and “as available”, without warranties of any kind, express or implied. A keyboard that corrects and predicts will sometimes be wrong; we measure how often and publish the figures, and we design it to leave your words alone when in doubt, but we do not warrant that it will be error-free, that a particular correction will be right, or that it will meet your particular needs. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow these exclusions; there, our warranties are limited to the minimum scope and duration the law permits, and nothing here limits consumer rights that cannot be excluded by agreement.
14. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive loss, or for loss of data, profit, business or goodwill, arising from your use of or inability to use Pilcrow.
Our total aggregate liability for any claim relating to Pilcrow is limited to the greater of (a) the amount you paid for Pilcrow in the twelve months before the claim, or (b) EUR 50.
Nothing here excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or for fraudulent misrepresentation. Where applicable law does not permit the full exclusion above, our liability is limited to the maximum extent that law permits.
15. Termination
You may stop using Pilcrow at any time by deleting it; deleting the app removes everything it learned from your device. Cancelling a subscription is done in your Apple Account settings, not by deleting the app.
We may terminate this licence if you materially breach these terms. On termination your right to use Pilcrow ends; a one-time purchase already made is not refunded on termination for breach. Sections 11, 13, 14, 17 and 19 survive.
16. If something goes wrong
Before bringing a formal claim, please write to info@pilcrowtype.com and give us 30 days to put it right. Nearly everything can be settled that way, and we would rather fix a bug than argue about one.
If that does not work, the dispute is handled under section 17. Nothing in this section limits your right to bring proceedings in your own country of residence where mandatory consumer law gives you that right, or to use the European Commission’s online dispute-resolution platform.
17. Governing law
These terms are governed by the laws of the EU member state in which we are established, without regard to conflict-of-law rules. The competent courts of that member state have jurisdiction, except that (a) as a consumer you may bring proceedings in the courts of your country of residence where mandatory consumer-protection law gives you that right, and those rules continue to apply to you regardless of this section, and (b) we may bring proceedings to protect our intellectual property in any competent court.
18. Changes to these terms
We may update these terms. The current version is always at this address with its effective date and version number. If a change materially reduces your rights, we will say so in the app before it takes effect, and where reasonably practicable at least 14 days in advance. Continuing to use Pilcrow after that date means you accept the change; if you do not, stop using Pilcrow and cancel any plan. Changes never apply retroactively to a purchase already made.
19. General
Entire agreement
These terms, with the Privacy policy, are the entire agreement between you and us about Pilcrow, and replace anything said before.
Severability
If any provision is held invalid or unenforceable, the rest stays in force, and the invalid provision is replaced by an enforceable one that comes closest to its intent.
No waiver
If we do not enforce a right or provision, that is not a waiver of it.
Assignment
You may not assign or transfer these terms. We may assign them in connection with a merger, acquisition, reorganisation or sale of assets, with notice to you.
Force majeure
We are not liable for a failure or delay caused by events beyond our reasonable control, including natural events, war, civil unrest, pandemic, labour disputes, internet or telecommunications outages, government action, or the failure of a third-party provider.
Notices
We may give notice through the app or on this site. You may write to us at info@pilcrowtype.com.
Language
These terms are written in English. Any translation is for convenience; the English version governs in case of conflict.
